What Is Mediation?

Mediation is a process by which two parties present their dispute to a neutral third party, the mediator. The mediator acts as an intermediary, encouraging both sides to find common ground in an effort to resolve the dispute. The mediator is not a judge and cannot make any decisions for the parties. The mediator works to get the parties to come to an agreement. If the parties come to an agreement, the terms become part of a contract that may be enforceable in court

Mediation has become an increasingly popular method of cost-effective dispute resolution.  Often, parties lack the resources or the desire to expend the amounts necessary for litigation. By participating in mediation, the parties can work towards an agreement and save time and money which would otherwise be spent litigating their claims.

How Does Mediation Work in a Divorce or Family Law Case?

In most other legal disputes, at the end of the case there is generally a winner and a loser. However in Divorce and Family Law cases there seldom is a clear “winner” at the end of the case. In most instances it is in the parties’ interest to resolve the issues themselves rather than have a judge make a decision for them that they will have to live with the rest of their lives.

In a Divorce or Family Law mediation, each side presents its version of the facts and the issues to the mediator. The mediator listens and attempts to identify those facts upon which the parties agree. The mediator also works with the parties to identify the specific results that are most important to each party and what they would be willing to give up to obtain those specific results. At this point, mediation can become a negotiating process, with the mediator facilitating the negotiation.
