post judgment modification is a legal process in which
one party seeks to have the standing Court Order amended due to
changes of the circumstances which lead to the stipulations of
the standing Court Order. Post judgment modifications are
typically associated with Child Support, Child Custody, Visitation, and
Spousal Support - Alimony.

Modifications of Child Support
Modification of child support is always possible. But there
must be a substantial and material change in circumstances in
the income, usually of the parent who is paying the child
support. It is important that the guidelines are properly

A modification to
a child custody or child visitation order may
requested by either parent. Sometimes a modification to a
child custody or child visitation order is a joint
request when both parents agree upon the modifications
being requested. It is important to remember that even if both
parents agree on the modifications, unless a court
approves the child custody and child visitation
agreement, it is impossible to enforce the changes if one parent
chooses not to honor the mutual agreement.
When a parent
wants to change an existing court order and the other parent
does not agree to the change, he or she must file a motion
requesting the designated court to modify the court order. In
most cases, the court will only modify an existing order if the
parent requesting the child custody or child
visitation modification can show a "substantial change in
circumstances" which warrants such a request, and that the
modification request is in the best interest of the child
/ children.
Modifications of Spousal Support -
Alimony
The amount of
Spousal Support one spouse must pay another after a divorce
determined by the court, based upon a number of mitigating
factors. It is important to remember that after a divorce, the
circumstances and financial standing of either spouse often
changes over time.
Because of these
changes, either spouse may formally request the court to
modify the standing court order regarding spousal support.
Alimony modification requests are often made after a spouse
looses a job or their earning potential changes, the spouse
receiving spousal
support gets re-married, or the spouse receiving the
spousal support has a significantly higher change in the level of
his or her income.
Spousal Support is
not intended to punish the spouse which make more money, but to
provide financial support so that the one receiving spousal
support - alimony may continue living at the level that he
or she has become accustomed to during the marriage. Any change
to either parties financial standing may prompt a spousal
support modification
order by the court.
